1. Scope of application
1.1. These Terms of Use regulate the use of the Website.
1.2. The Terms of Use constitute the entire agreement between NeoKingdom and the User. They shall take precedence over other sources of information (e.g. the marketing materials) and interpretations (e.g. explanations provided by the Website user support).
2. Definitions
2.1. NeoKingdom means the company NeoKingdom DAO OÜ (registry code 16638166), with its address at Laki 11/1, 12915 Tallinn, Estonia, which is the owner and administrator of the Website.
2.2. The Website is the website https://www.neokingdom.org including all its subdomains and aliases, with all of its components, contents and software required for its functioning.
2.3. The User is every person who uses the Website, including only visits.
3. General terms and conditions
3.1. The User, while using the Website, including only visiting the Website, confirms that they have examined and agreed with the Terms of Use and the data processing principles connected therewith, including the conditions of cookie use which are available at: https://www.neokingdom.org/privacy-policy/.
3.2 The only purpose of the Website is to provide information about NeoKingdom. It is prohibited to use the Website for any other purpose.
3.3. Every person must make sure that they have the right to use the Website. A person who is not entitled to use the Website (e.g., if the law applicable to the person prohibits them to access information provided on the Website) shall avoid using the Website in any way, including avoid visiting the Website.
3.4. NeoKingdom will be entitled to promptly limit the access of any person to the Website if it turns out that such person does not have the right to use the Website for any reason whatsoever.
3.5. NeoKingdom will be entitled to prohibit any person to use the Website if allowing it would be in conflict with NeoKingdom’s business ethics, moral values or public order. NeoKingdom will be entitled to promptly limit the access of such person to the Website.
3.6. The User is prohibited from using the Website in any unlawful manner, including copying any works protected by copyright from the Website, or in any other manner infringing the Terms of Use. NeoKingdom will be entitled to promptly limit the access of such person to the Website.
4. Protection of the functioning and contents of the Website
4.1. The User confirms that they shall avoid any activities, the purpose of which is or which bring about:
4.1.1. Processing of the data of other Users, including recording in any part or form;
4.1.2. Use of the Website in a manner different from the purpose thereof, including for sending of spam mail or for other inadvisable communication;
4.1.3. Interfering with the work of the Website in any manner, including attacking the Website or its server, or interfering with its normal use in any other manner;
4.1.4. Hindering other Users from using the Website;
4.1.5. Copying, reproducing, modifying, duplicating, making available to third parties or otherwise exploiting any contents of the Website;
4.1.6. Modifying or deleting any contents of the Website;
4.1.7. Scanning the Website or exploring it in any other manner with a device with the purpose of determining the technical structure and principles of functioning of the Website, data recorded on the Website and other files of the Website.
4.2. NeoKingdom grants the right to public search engines to use relevant tools and reproduce the contents of the Website to the extent necessary for effectively finding the Website and displaying introductory information to the public in search engines.
5. Limited liability of NeoKingdom
5.1. The liability of NeoKingdom with regard to the Website is limited to the minimum permitted under applicable laws and regulations. For example, NeoKingdom will never be liable for:
5.1.1. Any other than direct proprietary damage;
5.1.2. Any violation of the Terms of Use, except in case of intentional violation;
5.1.3. Any damage caused by a third person;
5.1.4. Any damage caused by a temporary technical failure of the Website;
5.1.5. The fact that a User feels discriminated or offended by any information on the Website, unless the publication of such information or expressing such position is prohibited in Estonia.
5.2. The User confirms that they shall never submit a claim regarding the Website against the management board, employees, service providers or other related persons of NeoKingdom.
6. Final provisions
6.1. NeoKingdom may amend the Terms of Use and the documents referred to herein at any time. The User shall become acquainted with the amendments.
6.2. Should the User not agree with any amendments to the Terms of Use, the User will have to refrain from further use of the Website.
6.3. Should the User continue to use the Website, the User thereby confirms that the amendments are suitable, and they will be deemed to have agreed with the amendments.
6.4. The Terms of Use do not provide any rights to third persons.
6.5. The Terms of Use and all legal relationships created hereunder shall be governed by Estonian law.
6.6. Issues not regulated under the Terms of Use shall be governed by relevant laws and regulations in good faith and considering the spirit of the Terms of Use.
6.7. If any provision of the Terms of Use appears to be in conflict with applicable laws and regulations, it shall not affect the validity of the remaining Terms of Use. The conflicting provision shall then be replaced with such provision of the applicable regulations, the purpose of which is as close as possible to the replaced provision of the Terms of Use.
6.8. Any disputes regarding the Terms of Use and the legal relationships created hereunder shall be settled by negotiations between NeoKingdom and the User. Should negotiations fail, the interested party shall have a recourse to Harju County Court.
